Upon execution of the warrant, you will be required to complete the Result of Search for the Magistrate. This guide covers the procedure **during** COVID whereby the Result of Search is completed via photograph. # Step 1: Memo Complete a VP-Memo (Large) similar to the following: > To: Melbourne Magistrates' Court > From: First Constable Joe BLOGGS 44425 > File Number: Search Warrant XXXX/XX > Date: 10/01/2021 > > Reference: Result of Search for Search Warrant XXXX/XX at 1 Viewmount Road, Glen Waverley VIC 3100. > > Hello, > > Please find the attached result of search for Search Warrant XXXX/XX at the above address, photographs of each item are also attached.** > > 1. 1x Pair of Pants > 2. 2x Gloves > 3. etc. # Step 2: Affidavit In Support You must then complete an Affidavit in support that states the items that were seized and what you would like done with those items. Be specific and careful at this point, you want to send the items to the correct place under the Magistrates Order. > I, Joe BLOGGS of Transit Divisional Response Unit, 311 Spencer Street, Docklands VIC 3008, a member of Victoria Police, make an oath/affirmation and say that: > > 1. That on the DAY of MONTH 2021, a search warrant authorized pursuant to the Crimes Act 1956 were issued by the court with the reference number XXXX/21. > 2. That on the DAY of MONTH 2021, I was present when the above mentioned warrants were executed and items were seized. > 3. The items seized are listed in the result of search document or attached property record. > 4. The photo images produced truly and accurately depict those items seized under the search warrant as set out in the result of search. > 5. All items are currently located at Transit Divisional Response Unit Property Office, 313 Spencer Street Docklands. > 6. Items 1 – 7 are to be retained in [[possession]] of police pending production at court. > 7. Items 2, 3 and 5 are to be conveyed to a **unit within Victoria Police that has forensic capability** for analysis. These items may be altered from their original state as a result of analysis/testing. > 8. Pursuant to the Magistrates’ Court Act 1989 s.78(5), I produce the items to the Court as required by s.78(1)(9B)(ii), by way of photograph. It is important in reference to the items you seize where you want them to go to get analysed. Your two options are: A unit within Victoria Police (e.g. E-Crime, phones, computers, etc.) OR the Victoria Police Forensic Services Centre (e.g. Forensics, drugs, weapon, etc.) Items 1 - 5 are to be conveyed to the Victoria Police Forensics Services Centre for analysis. These items may be altered from their original state as a result of analysis/testing OR Items 1 - 5 are to be conveyed to a unit within Victoria Police that has forensic capability for analysis. These items may be altered from their original state as a result of analysis/testing. Ensure two signatures are made and the date is updated appropriately.  # Step 3: Result of Search Documentation Ensure whatever is labelled on the Property Seizure Record is VISIBLE in the photograph. E.g. if you note down a serial number, that serial number must be visible on provided photographs of the Magistrate. You should compile the documents in the following order: - VP Memo - Result of Search Warrant Affidavit in Support - Search Warrant Original - Result of Search (Signed and Executed) - Property Seizure Record - Photograph of item with item cover sheet visible in picture (e.g. Exhibit 1, Exhibit 2, etc.) If you have more then one warrant, start from the beginning and repeat the process. Do not have two Warrants on top and all the items seized underneath. Keep them separate. # Step 4: Sending Then do the following: - **Scan a copy of the documentation and upload it to the Search Warrant Interpose Shell in case it goes missing!** - Send via post to the relevant court for it to be signed off & returned, this can take quite a long time.
